CE mark and B construction mark
Placing a construction product on the market in a European Union country is possible only when the product meets basic safety and quality requirements; when it has been examined and received the CE mark, together with a conformity certificate.
On 1 May 2004 Polish legal acts incorporating the New Approach directive came into force. Upon joining the European Union it became obligatory to place the CE mark on the numerous products released in Poland. The provisions of the above directive are contained within the Polish conformity assessment system Act, dated 30 August 2002. The rules for assessing conformity of construction products with standards and those for marking products with the CE mark are laid down in the Regulation of the Minister of Infrastructure, dated 11 August 2004, on systems of assessing conformity, requirements for notified bodies participating in the assessment of conformity and manner of marking construction products with the CE mark. The Regulation lists six types of conformity assessment system for construction products, with these differing in the degree of involvement of the manufacturer and notified bodies. Company production control is the basic element of all assessment systems. Put simply, if a manufacturer does not operate a company production control system, it does not have the right to mark its products with the CE symbol.
Thus the marking of a product with the CE mark means that the product was submitted for a relevant conformity assessment procedure laid down in the New Approach directives. The marking is equal to a declaration by the manufacturer that the product meets the fundamental requirements specified in the provisions.
If a product cannot be marked with the CE mark (in the absence of a European product standard and European technical approvals), the B mark will be an equivalent. The B construction mark is awarded as part of the national construction product marking system. A manufacturer may mark its products with the B construction mark provided that it has submitted the products for conformity assessment and issued, upon its sole responsibility, a national declaration of the conformity of the product with the Polish Standard or technical approval.
It should be noted that the responsibility for adjustment of products and the holding of relevant documentation is placed not only on the manufacturer, but also on other participants in the construction product distribution chain: distributors, salespersons and design companies and contractors.
Failure to fulfill these obligations may result in such a product being placed in the National Questioned Products Register and its withdrawal from the market (should the product be withdrawn from the market, the sold product should be repurchased from clients), and may also entail the imposition of a fine, of as much as PLN 100,000.
For CDA the prestige of the company is also important. Our having the CE or B mark on our products signifies the greater stability of the company and the quality of its products. We assume that a potential client presented with a choice of products marked with the CE or B mark and without it (at the same or a slightly different price) will buy the product marked.
